7. HOW WE USE YOUR PERSONAL DATA
7.1a Lawful basis: UK and EU
We will only Process your Personal Data when we have a lawful basis to do so. We will Process your Personal Data under the following lawful bases:
• Contract performance: where we need to Process your Personal Data to perform the contract we have entered into with you.
• Legitimate interests: where we need to use your Personal Data for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests. We consider any potential impact on you and your rights when determining whether we can Process your Personal Data for our legitimate interests.
• Recognised legitimate interests (RLIs): we may sometimes use your Personal Data because we (or a third party) have a recognised legitimate interest. RLIs are defined under Data Protection Law and apply to our Processing where there are public interest reasons for Processing (such as preventing or detecting crime, safeguarding individuals, responding to emergencies, or sharing information with public bodies). Where we rely on an RLI, we will ensure the use is strictly necessary and only use or share the minimum Personal Data required.
• Legal obligation: where we need to use your Personal Data to comply with a legal or regulatory obligation.
• Vital interests: less commonly, we may need to Process your Personal Data in emergency situations when it is in your vital interests or those of another person.
When we Process your Personal Data for the purposes of recruitment, the legal basis we rely on is normally that the Processing is necessary for our legitimate interest in being able to recruit talent with the relevant competence. We have assessed these interests against your fundamental rights and freedoms and have concluded that this is an appropriate lawful basis.
There may be specific circumstances when the Processing is only performed if and when you provide your consent. This is, for example, the case if we propose to record an interview with you.
Where we Process any Special Category Data and/or Criminal Offence Data, we will ensure we have the appropriate lawful basis and are able to rely on an additional ground identified under Data Protection Law to do so.
7.1b Lawful basis: Singapore
In respect of individuals engaged by our Singapore branch, the PDPA requires that we obtain your consent (or rely on deemed consent or an applicable exception under the PDPA) before collecting, using or disclosing your Personal Data. You may be deemed to have consented to the collection, use or disclosure of your Personal Data where you voluntarily provide it to us for a purpose and it is reasonable that you would do so, or where deemed consent by notification applies. Where we rely on deemed consent by notification, we will conduct an assessment to determine that the proposed collection, use or disclosure is not likely to have an adverse effect on you, and will take reasonable steps to bring to your attention our intention to collect, use or disclose the Personal Data, the purpose for which the Personal Data will be collected, used or disclosed and a reasonable period within which you may notify us that you do not consent. Where we collect, use or disclose your Personal Data without consent, we will do so only in accordance with the exceptions permitted under the PDPA, including where it is necessary for evaluative purposes, entering into, managing or terminating the employment relationship with you, or for any investigation or proceedings.
We will make reasonable efforts to ensure that Personal Data collected by or on behalf of us is accurate and complete where such Personal Data is likely to be used by us to make a decision that affects you or is likely to be disclosed by us to another Organisation, in accordance with the PDPA.
7.1c Lawful basis: US
If you are located in the United States, the legal bases described in this notice are not required and are set out for transparency only, and we Process your personal data for the purposes described in this notice to the extent permitted by applicable law and in compliance with Data Protection Law.
7.2 Processing your Personal Data for new purposes
In the UK and EU, before we Process your Personal Data for any new purpose, we will ensure the Processing is fair and lawful. In particular, we will confirm that an appropriate lawful basis applies to the new purpose and (where relevant) that any additional requirements for Special Category Data and Criminal Offence Data are met. We will carefully consider whether any new use is compatible with the original purpose for which your information was collected, taking into account:
• How closely connected the new purpose is to the original one.
• The context in which your information was collected, including your reasonable expectations at the time.
• The nature and sensitivity of the information involved.
• The potential impact on you.
• The safeguards we have in place to protect your information.
We will not use your Personal Data in ways that are unexpected, unfair, or that could have an unjustified negative impact on you.
Where we do intend to use your Personal Data for a new purpose, we will inform you and provide any relevant information before doing so. In some cases, you will have the right to object to that use, and we will make you aware of this right whenever it applies.
In respect of individuals engaged by our Singapore branch, we will inform you of the purposes for which we collect, use or disclose your Personal Data on or before collecting such data, in accordance with the PDPA. We will only collect, use or disclose your Personal Data for purposes that a reasonable person would consider appropriate in the circumstances. Where we intend to use or disclose your Personal Data for a purpose of which you have not previously been informed, we will notify you of that purpose before such use or disclosure. On request, we will provide you with the business contact information of a person who is able to answer your questions about the collection, use or disclosure of your Personal Data on our behalf.

• If you are hired, we will keep your personal data during your employment, for other purposes than those stated above, of which you will be informed.
• For References, we keep your personal data for as long as we keep the personal data of the Candidate for whom you acted as a reference.
17. YOUR RIGHTS IN RELATION TO YOUR PERSONAL DATA
You have rights under Data Protection Law set out in this section below. These rights may differ depending on your jurisdiction of residence and the relevant Data Protection Law applicable to you as we have identified below. Please note that, if you are in Florida, none of the rights described in this section apply.
• Right to access: If you are in the UK/EU, you may request access to your Personal Data (commonly known as making a data subject access request). If you are in Singapore, you may also request for information about the ways in which such Personal Data has been or may have been used or disclosed by us within the year preceding your request.
• Right to rectification: If you are in the UK/EU, you may request rectification of the Personal Data that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected. If you are in Singapore, we will also send the corrected Personal Data to every other Organisation to which the Personal Data was disclosed by us within the year preceding the date the correction was made, unless that other Organisation does not need the corrected personal data for any legal or business purpose.
• Right to erasure: If you are in the UK/EU, you may request erasure of your Personal Data. This enables you to ask us to delete or remove Personal Data where there is no good reason for us continuing to Process it. Please note that if you are in Singapore, there is no equivalent right to erasure or to be forgotten and we will retain your Personal Data in accordance with section 16 of this notice.
• Right to restriction: If you are in the UK/EU, you may request the restriction of Processing of your Personal Data. This enables you to ask us to suspend the Processing of Personal Data about you, for example if you want us to establish its accuracy or the reason for Processing it.
• Right to data portability: If you are in the UK/EU, you can request a copy of the personal data relating to you that we Process for the performance of a contract with you, or based on your consent, in a structured, commonly used, machine-readable format. If technically feasible, you also have the right to request that we transfer your data directly to another recipient.
• Right to object: If you are in the UK/EU, you may object to Processing of your Personal Data where we are relying on a legitimate interest (or those of a third party) and there is something about your situation which makes you want to object. You also have the right to object where we are Processing your Personal Data for direct marketing purposes.
• Right to withdraw consent: If you are in the UK/EU, where we Process your Personal Data based on your consent, you have the right to withdraw that consent at any time. If you do so, we will stop Processing your data for the purposes for which you have withdrawn your consent. Withdrawal of consent does not affect the lawfulness of Processing carried out before the withdrawal. If you are in Singapore, you may at any time withdraw any consent given or deemed to have been given under the PDPA for the collection, use or disclosure of your Personal Data, by giving us reasonable notice. Upon receipt of your notice of withdrawal, we will inform you of the likely consequences of such withdrawal. Following your withdrawal of consent, we will cease (and cause our data intermediaries and agents to cease) collecting, using or disclosing your Personal Data for the relevant purpose, unless such collection, use or disclosure without your consent is required or authorised under the PDPA or other written law. We will not prohibit you from withdrawing your consent, although such withdrawal will not affect any legal consequences arising therefrom.
If you want to exercise these rights, please contact the relevant contact in your region as set out in Appendix I. Ordinarily you will not have to pay a fee to exercise any of these rights. However, we may charge a reasonable fee if your request is manifestly unfounded or excessive. Alternatively, we may refuse to comply with the request where permissible under Data Protection Law. For example, in respect of individuals engaged by our Singapore branch, where we are unable to provide you with access to your Personal Data or decline to make a correction, we will notify you of the reasons for our decision within the prescribed time and in accordance with the prescribed requirements under the PDPA.
